CareChamp – Terms & Conditions

These Terms & Conditions (“Terms”) govern all purchases and use of services, courses, products, and placements offered through carechamp.co.za. By placing an order or using our services, you agree to these Terms. Please read them carefully.

1. What We Offer

CareChamp provides:

  • Managed Care Services: caregiver shifts, nursing assessments & procedures, companion care shifts.

  • Private Placements: permanent hiring of caregivers or nannies.

  • Courses & Training: digital and in-person programmes.

  • Products: physical goods delivered to customers.

2. Orders & Payment

  • Prices shown include VAT unless stated otherwise.

  • Payment must be made in full at checkout unless agreed otherwise.

  • We accept credit/debit cards, EFT, debit order and other payment options shown at checkout.

  • Orders are confirmed once payment is received.

3. Delivery & Performance

  • Services: Appointments will be confirmed at booking. We may reschedule due to unforeseen circumstances, in which case you may accept a new date or request a refund.

  • Courses:

    • Digital courses: access details are sent after payment.

    • In-person courses: take place at the confirmed location and date.

  • Products: Delivery timelines and fees are displayed at checkout. We are not responsible for courier delays once dispatched, but will assist where possible.

4. Cancellations, Returns & Refunds

4.1 Care Services

  • Cancellations 72+ hours before service: refundable or reschedulable.

  • Cancellations within 72 hours: non-refundable.

  • If we cannot provide the service, you may request a refund or reschedule.

4.2 Private Placements

  • Placement fees are non-refundable once a caregiver has been placed.

  • If the placement fails within the agreed probation period, CareChamp will provide a replacement or refund, as per your placement agreement.

4.3 Courses & Training

  • Digital courses: non-refundable once access details are issued.

  • In-person courses:

    • Cancellations 7+ days before start: refund (minus 10% admin fee).

    • Cancellations within 7 days: non-refundable, but transferable to another date or participant.

  • If CareChamp cancels, you may request a refund or transfer.

4.4 Products (Physical Goods)

  • Returns accepted within 7 days of delivery if unused, unopened, and in original packaging.

  • Excluded items: personal care, hygiene-sensitive products, opened consumables.

  • Defective or damaged products must be reported within 7 days; we will arrange replacement, repair, or refund in line with the Consumer Protection Act (CPA).

4.5 Refund Processing

  • Approved refunds are processed within 7 business days to the original payment method.

5. User Responsibilities

  • You must provide accurate information when creating an account or making a booking.

  • You may not misuse our website, app, or services (e.g. unlawful conduct, unauthorised access, interference with systems).

  • CareChamp may suspend or terminate accounts in cases of misuse.

6. Service Disclaimer

  • CareChamp connects clients with trained caregivers, nurses & ECD practitioners. We carefully screen care workers, but outcomes of care cannot be guaranteed.

  • Services are provided on a professional best-effort basis.

  • Courses are for training purposes only; CareChamp is not responsible for how knowledge or skills are later applied.

7. Limitation of Liability

  • To the extent permitted by law, CareChamp is not liable for indirect, incidental, or consequential losses (e.g. lost income).

  • Our total liability for any claim is limited to the amount you paid for the relevant service, course, or product.

  • Nothing in these Terms limits your statutory rights under the Consumer Protection Act (CPA).

8. Intellectual Property

  • All course materials, website content, and brand assets are owned by CareChamp.

  • You may use course materials for personal, non-commercial learning only.

  • You may not copy, distribute, or resell our materials without permission.

9. Privacy & Data

  • CareChamp complies with the Protection of Personal Information Act (POPIA).

  • We collect and use personal data only as described in our [Privacy Policy].

  • Caregiver and client information is managed securely through our app, with access limited to what is necessary for each assignment.

10. Changes to Terms

We may update these Terms from time to time. Updated Terms apply to all future orders.

11. Governing Law & Disputes

  • These Terms are governed by South African law.

  • Any disputes shall be resolved in the courts of Cape Town, South Africa.
